고압가스 안전관리법 제4조(고압가스의 제조허가 등)

① 고압가스를 제조(용기 또는 차량에 고정된 탱크에 충전하는 것을 포함한다. 이하 같다)하려는 자는 그 제조소마다 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장(구청장은 자치구의 구청장을 말하며, 이하 "시장ㆍ군수 또는 구청장"이라 한다)의 허가를 받아야 한다. 허가받은 사항 중 산업통상부령으로 정하는 중요 사항을 변경하려는 경우에도 또한 같다. <개정 2008.2.29, 2009.5.21, 2013.3.23, 2014.1.21, 2020.2.4, 2025.10.1>

② 제1항에도 불구하고 대통령령으로 정하는 종류 및 규모 이하의 고압가스를 제조하려는 자는 산업통상부령으로 정하는 바에 따라 시장ㆍ군수 또는 구청장에게 신고하여야 한다. 신고한 사항 중 산업통상부령으로 정하는 중요 사항을 변경하려는 경우에도 또한 같다. <개정 2008.2.29, 2009.5.21, 2013.3.23, 2025.10.1>

③ 시장ㆍ군수 또는 구청장은 제2항에 따른 신고를 받은 날부터 2일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.3.20>

④ 시장ㆍ군수 또는 구청장이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.3.20>

⑤ 저장소를 설치하려는 자 또는 고압가스를 판매하려는 자는 그 저장소나 판매소마다 시장ㆍ군수 또는 구청장의 허가를 받아야 한다. 허가받은 사항 중 산업통상부령으로 정하는 중요 사항을 변경하려는 경우에도 또한 같다. <개정 2008.2.29, 2009.5.21, 2013.3.23, 2018.3.20, 2025.10.1>

⑥ 제1항과 제5항에 따른 허가의 종류 및 기준과 대상범위는 대통령령으로 정하고, 고압가스의 제조ㆍ저장 및 판매에 필요한 시설기준과 기술기준은 산업통상부령으로 정한다. <개정 2008.2.29, 2013.3.23, 2018.3.20, 2025.10.1>

⑦ 제1항부터 제5항까지의 규정에 따른 허가를 하거나 신고를 받은 관청은 7일 이내에 그 허가 또는 신고 사항을 관할 소방서장에게 알려야 한다. <개정 2018.3.20>
