결핵예방법 제8조(의료기관 등의 신고의무)

① 의사 및 그 밖의 의료기관 종사자는 다음 각 호의 어느 하나에 해당하는 경우에는 지체 없이 소속된 의료기관의 장에게 보고하여야 한다. 다만, 의료기관에 소속되지 아니한 의사는 그 사실을 관할 보건소장에게 신고하여야 한다. <개정 2014.1.28>

② 제1항 본문에 따른 보고를 받은 의료기관의 장은 24시간 이내에 관할 보건소장에게 신고하여야 한다. <신설 2014.1.28, 2018.3.27>

③ 의료기관에 소속되지 아니한 의사 또는 제2항에 따른 의료기관의 장은 제1항제1호에 해당하여 신고한 결핵환자등을 치료한 결과를 관할 보건소장에게 보고하여야 한다. <신설 2014.1.28>

④ 제1항 단서 및 제2항에 따른 신고가 관할 구역 외의 환자에 관한 것일 때에는 신고를 받은 보건소장은 해당 관할 보건소장에게 지체 없이 이를 알려야 한다. <개정 2014.1.28>

⑤ 제1항부터 제3항까지의 규정에 따른 신고 또는 보고의 방법 및 절차 등에 필요한 사항은 보건복지부령으로 정한다. 그 밖에 신고와 보고에 관한 사항은 「감염병의 예방 및 관리에 관한 법률」 제11조부터 제13조까지 및 제15조를 준용한다. 이 경우 "감염병환자등"은 "결핵환자등"으로 본다. <신설 2014.1.28>
