건설폐기물의 재활용촉진에 관한 법률 제38조(순환골재 및 순환골재 재활용제품의 사용 의무)

① 발주자는 순환골재등 의무사용 건설공사를 발주할 때에는 건설업자에게 제35조에 따른 품질기준에 맞는 순환골재 및 대통령령으로 정하는 기준에 적합한 순환골재 재활용제품을 사용하게 하여야 한다. 다만, 다음 각 호의 어느 하나에 해당되는 경우에는 그러하지 아니하다.

② 발주자는 제1항 각 호 외의 부분 단서에 따라 순환골재등 의무사용 건설공사에 순환골재 및 순환골재 재활용제품을 사용하지 아니하려면 설계 등 용역업자, 건설업자 및 감리자의 검토의견서를 제출받아 「건설기술 진흥법」 제5조에 따른 건설기술심의위원회의 심의를 받거나 같은 법 제6조에 따른 기술자문위원회에 자문하여 그 의견을 받아야 한다. <개정 2013.5.22>

③ 제1항에 따른 순환골재 및 순환골재 재활용제품의 사용량 등에 관한 사항은 기후에너지환경부장관과 국토교통부장관이 정하여 고시한다. <개정 2013.3.23, 2025.10.1>

④ 발주자는 제1항 각 호 외의 부분 본문에 따라 순환골재등 의무사용 건설공사를 발주한 경우에는 기후에너지환경부령으로 정하는 바에 따라 순환골재 및 순환골재 재활용제품의 사용용도 및 예상사용량 등이 포함된 사용계획서를 작성하여 공사에 착공한 날부터 3개월 이내에 기후에너지환경부장관에게 제출하여야 한다. 이 경우 기후에너지환경부장관은 국토교통부장관이 요청하면 제출받은 내용을 통보하여야 한다. <개정 2013.3.23, 2025.10.1>
