Administrative Procedures Act, Article 8 (Administrative Assistance)

① 행정청은 다음 각 호의 어느 하나에 해당하는 경우에는 다른 행정청에 행정응원(行政應援)을 요청할 수 있다.

1. 법령등의 이유로 독자적인 직무 수행이 어려운 경우

1. Where웨어 it잇 is이즈 difficult디^f퍼컬트 to투 perform퍼^f폼 its잇츠 duties두티즈 independently인디펜던틀리 for^f포 reasons^r리즌즈 relating^r릴레이팅 to투 statutes,스태춧츠 etc.;엣세터^r러

2. 인원ㆍ장비의 부족 등 사실상의 이유로 독자적인 직무 수행이 어려운 경우

② 제1항에 따라 행정응원을 요청받은 행정청은 다음 각 호의 어느 하나에 해당하는 경우에는 응원을 거부할 수 있다.

(2) An앤 administrative어드미너스트^r레이티^v브 agency에이전시 requested^r리퀘스티드 to투 provide프^r러^v바이드 administrative어드미너스트^r레이티^v브 assistance어시스튼스 under언더 paragraph패^r러그^r래^f프 (1) may메이 refuse^r러^f퓨즈 to투 provide프^r러^v바이드 assistance어시스튼스 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

1. 다른 행정청이 보다 능률적이거나 경제적으로 응원할 수 있는 명백한 이유가 있는 경우

1. Where웨어 there^ð데어 is이즈 a어 clear클리어 reason^r리즌 that^ð댓 another어너^ð더 administrative어드미너스트^r레이티^v브 agency에이전시 can캔 provide프^r러^v바이드 assistance어시스튼스 more모 efficiently이^f피션틀리 or오 economically;에커나미클리

2. 행정응원으로 인하여 고유의 직무 수행이 현저히 지장받을 것으로 인정되는 명백한 이유가 있는 경우

③ 행정응원은 해당 직무를 직접 응원할 수 있는 행정청에 요청하여야 한다.

(3) A어 request^r리퀘스트 for^f포 administrative어드미너스트^r레이티^v브 assistance어시스튼스 shall섈 be비 made메이드 to투 an앤 administrative어드미너스트^r레이티^v브 agency에이전시 that^ð댓 can캔 directly더^r렉틀리 assist어시스트 with위^ð드 the^ð더 duties두티즈 concerned.컨선드

④ 행정응원을 요청받은 행정청은 응원을 거부하는 경우 그 사유를 응원을 요청한 행정청에 통지하여야 한다.

(4) Where웨어 an앤 administrative어드미너스트^r레이티^v브 agency에이전시 requested^r리퀘스티드 to투 provide프^r러^v바이드 administrative어드미너스트^r레이티^v브 assistance어시스튼스 refuses^r러^f퓨지즈 to투 do두 so,소우 it잇 shall섈 notify노우터^f파이 the^ð더 requesting^r리퀘스팅 administrative어드미너스트^r레이티^v브 agency에이전시 of어^v브 the^ð더 reasons.^r리즌즈

⑤ 행정응원을 위하여 파견된 직원은 응원을 요청한 행정청의 지휘ㆍ감독을 받는다. 다만, 해당 직원의 복무에 관하여 다른 법령등에 특별한 규정이 있는 경우에는 그에 따른다.

(5) Employees엠플로이이즈 dispatched디스패치트 to투 provide프^r러^v바이드 administrative어드미너스트^r레이티^v브 assistance어시스튼스 shall섈 be비 under언더 the^ð더 direction더^r렉션 and앤드 supervision수퍼^v비전 of어^v브 the^ð더 requesting^r리퀘스팅 administrative어드미너스트^r레이티^v브 agency:에이전시 Provided,프^r러^v바이디드 That^ð댓 where웨어 other어^ð더 statutes,스태춧츠 etc.엣세터^r러 specially스페셜리 provide프^r러^v바이드 for^f포 the^ð더 service서^v비스 of어^v브 those^ð도우즈 employees,엠플로이이즈 those^ð도우즈 provisions프^r러^v비전즈 shall섈 apply.어플라이

⑥ 행정응원에 드는 비용은 응원을 요청한 행정청이 부담하며, 그 부담금액 및 부담방법은 응원을 요청한 행정청과 응원을 하는 행정청이 협의하여 결정한다.
