해양수산생명자원의 확보ㆍ관리 및 이용 등에 관한 법률 제12조(외국인등에 대한 공동획득의 허가 등)

① 외국인등이 관할수역에서 대한민국 국민 및 국가기관(이하 "국민등"이라 한다)과 위임ㆍ위탁 또는 계약 등을 통하여 공동으로 제11조제1항 본문에 따른 획득을 하는 경우에는 외국인등 또는 공동획득에 참여하는 국민등은 같은 항 본문에 따른 허가를 받아야 한다. 다만, 제11조제1항 단서에 따른 허가등을 받은 경우(받은 것으로 보는 경우를 포함한다)에는 그러하지 아니하다. <개정 2020.5.26>

② 제1항 본문에 따른 허가를 받으려는 외국인등 또는 공동획득에 참여하는 국민등은 해양수산생명자원의 획득 예정일 6개월(연구를 목적으로 허가를 받으려는 경우에는 2개월을 말한다) 전까지, 같은 항 단서에 따라 허가등을 받은 외국인등 또는 공동획득에 참여하는 국민등은 해양수산생명자원의 획득 예정일 1개월 전까지 대통령령으로 정하는 사항을 포함한 조사계획서를 해양수산부장관에게 제출하여야 한다. <신설 2020.5.26>

③ 제1항에 따른 허가에 관하여는 제11조제3항부터 제5항까지의 규정을 준용한다. 이 경우 "외국인등"은 "외국인등 또는 공동획득에 참여하는 국민등"으로 본다. <개정 2020.5.26>
