①초등학교 및 중학교의 장은 다음 각 호의 어느 하나에 해당하는 학생에 대하여 학칙이 정하는 바에 따라 정원 외로 학적을 관리할 수 있다. <개정 2016.10.18, 2024.4.23>

② 초등학교 및 중학교의 장은 다음 각 호의 어느 하나에 해당하는 사람이 다시 학교에 다니거나 취학하려는 경우 「조기진급 등에 관한 규정」 제5조에 따른 조기진급ㆍ졸업ㆍ진학 평가위원회가 실시하는 교과목별 이수인정평가의 결과에 따라 학년을 정할 수 있다. 다만, 제98조의2제1항제3호 각 목의 어느 하나에도 해당하는 사람에 대하여 교육감이 같은 조 제1항에 따른 학력심의위원회(이하 "학력심의위원회"라 한다)의 평가 및 심의를 거쳐 학년을 정한 경우에는 그에 따라야 한다. <개정 2017.11.28, 2024.4.23>
