첨단재생의료 및 첨단바이오의약품 안전 및 지원에 관한 법률 제16조(인체세포등의 채취)

① 세포처리시설의 장은 인체세포등을 채취하고자 하는 경우 의료기관에서 의사가 직접 채취하도록 하거나 「의료법」 제2조에 따른 의사를 제외한 의료인이 의사의 감독 하에 채취하도록 하여야 한다.

② 의료인은 제1항에 따라 인체세포등을 채취하는 경우 실시대상자와 인체세포등의 기증자의 건강에 지장을 주지 아니하는 방법으로 행하여야 한다. <개정 2024.2.20>

③ 의료인은 인체세포등을 채취하기 전에 채취의 대상이 되는 본인으로부터 다음 각 호의 사항이 포함된 서면동의를 받아야 한다. <개정 2024.2.20>

(3) Before비^f포 collecting컬렉팅 human휴먼 cells,셀즈 etc.,엣세터^r러 medical메더클 personnel퍼서넬 shall섈 obtain어브테인 written^r리튼 consent컨센트 from^f프^r럼 the^ð더 person퍼슨 from^f프^r럼 whom훔 they^ð데이 are아 to투 be비 collected,컬렉티드 containing컨테이닝 the^ð더 following:^f팔로잉

④ 제3항에도 불구하고 인체세포등의 채취대상자가 미성년자인 경우에는 본인과 그 부모(부모가 없는 경우에는 법정대리인을 말한다)의 동의를 함께 받아야 하고, 본인이 동의 능력이 없거나 불완전한 사람인 경우에는 다음 각 호에서 정한 대리인의 서면동의를 받아야 한다. 이 경우 동의 능력이 없거나 불완전한 사람에 대한 인체세포등의 채취는 본인 스스로의 치료를 위한 경우에 한정한다.

⑤ 제3항 및 제4항에 따라 인체세포등의 채취에 동의한 채취대상자, 그 대상자의 법정대리인 또는 가족은 인체세포등의 안전성을 확인하기 위하여 필요한 신상 및 병력에 관한 정보를 사실대로 성실하게 제공하여야 한다.

⑥ 이종세포, 이종세포를 추출하기 위한 조직 및 이종장기는 대통령령으로 정하는 바에 따라 「동물보호법」 제2조제13호에 따른 동물실험시행기관에서 의료인이 아닌 자도 채취할 수 있다. <개정 2022.4.26>

⑦ 제3항 및 제4항에 따른 동의의 내용, 절차, 그 밖에 필요한 사항은 대통령령으로 정한다.
