Enforcement Decree of the Local Accounting Act, Article 44 (Advance Payments)
① 법 제35조에 따라 선금급으로 지급할 수 있는 경비는 다음 각 호와 같다. <개정 2020.6.2, 2024.2.15, 2024.4.16, 2026.6.2>
(1) The expenses that may be paid as advance payments under Article 35 of the Act are as follows:
1. 토지 또는 건물의 임차료와 용선료(傭船料)
1. Rent for land or buildings and charter fees;
2. 운임 및 사례금
2. Freight and honoraria;
3. 국가ㆍ지방자치단체 또는 국가ㆍ지방자치단체의 업무를 대행하는 기관(제8조제6항 각 호의 기관을 포함한다)에 지급하는 경비
3. Expenses paid to the State, local governments, or institutions that perform affairs of the State or local governments on their behalf (including the institutions in each subparagraph of Article 8 (6));
4. 부담금ㆍ교부금 및 보조금
4. Charges, grants, and subsidies;
5. 지방자치단체가 매수하거나 수용하는 토지 또는 그 토지 위에 있는 물건의 대금ㆍ보상금 또는 이전료
5. Prices, compensation, or relocation costs for land purchased or expropriated by a local government or goods on that land;
6. 시험ㆍ연구 또는 조사의 수임인에게 지급하는 경비
6. Expenses paid to a mandatary of tests, research, or surveys;
7. 관보 등 정기간행물의 대금
7. Prices of periodicals such as the Official Gazette;
8. 외국에서 직접 구입하는 기계ㆍ도서ㆍ표본 또는 실험용 재료의 대금
8. Prices of machinery, books, specimens, or experimental materials purchased directly from foreign countries;
9. 외국에서 연구 또는 조사에 종사하는 자에게 지급하는 경비
9. Expenses paid to persons engaged in research or surveys abroad;
10. 교통이 불편한 곳에 근무하는 사람 또는 선박 승무원에게 지급하는 급여
10. Salaries paid to persons working in places with inconvenient transportation or to vessel crews;
11. 외국 원조사업으로서 국내에서 외국기관 또는 외국인에게 공사나 제조를 하게 할 때 필요한 경비
11. Expenses necessary for having foreign institutions or foreign nationals carry out construction or manufacturing in Korea as a foreign aid project;
12. 보수지급일에 전출 또는 출장을 가거나 휴가를 받을 사람에게 지급하는 급여
12. Salaries paid to persons who will be transferred, go on a business trip, or take leave on the remuneration payment date;
13. 공사ㆍ제조 또는 용역 계약의 대가로서 계약금액의 100분의 70을 초과하지 않는 금액
13. As consideration for a construction, manufacturing, or service contract, an amount not exceeding 70 percent of the contract amount;
14. 지방자치단체가 초청한 외국인에게 국내에서 지급하는 경비
14. Expenses paid in Korea to foreign nationals invited by a local government;
15. 재해 구호 및 복구에 드는 경비
15. Expenses for disaster relief and recovery.
② 제1항제13호에 해당하는 선금급은 「지방자치단체를 당사자로 하는 계약에 관한 법률」 등에 따라 계약을 체결한 후 계약상대방의 청구를 받은 날부터 14일 이내에 지급하여야 한다. 다만, 지방자치단체의 자금사정 등 불가피한 사유로 선금급의 지급이 불가능하여 그 사유를 계약 상대방에게 문서로 통지한 경우에는 선금급을 지급하지 아니할 수 있다.
(2) An advance payment under paragraph (1) 13 shall be paid within 14 days from the date of receiving the counterparty's request after concluding a contract under the Act on Contracts to Which a Local Government Is a Party, etc.: Provided, That where payment of the advance payment is impossible owing to unavoidable circumstances such as the financial condition of the local government and the counterparty is notified of the reason in writing, the advance payment need not be paid.
