Enforcement Decree of the Local Autonomy Act, Article 44 (Agencies Subject to Audits or Investigations of Administrative Affairs)

① 감사 또는 조사의 대상 기관은 다음 각 호와 같다.

1. 해당 지방자치단체

2. 법 제126조부터 제129조까지의 규정에 따른 해당 지방자치단체의 소속 행정기관과 법 제131조 및 제134조에 따른 하부행정기관 및 하부행정기구

4. 해당 지방자치단체가 설치한 법 제163조에 따른 지방공기업

6. 「지방자치단체 출자ㆍ출연 기관의 운영에 관한 법률」 제2조제1항에 따른 출자ㆍ출연 기관 중 지방자치단체가 4분의 1 이상 출자하거나 출연한 법인. 다만, 본회의가 특별히 필요하다고 의결하는 경우에는 지방자치단체의 출자 또는 출연에 관련된 업무ㆍ회계ㆍ재산으로 한정하여 실시한다.

② 지방의회는 제1항에 따른 감사 또는 조사 대상 기관의 사무가 둘 이상의 지방자치단체의 사무에 해당하는 경우에는 그 사무의 감사 또는 조사에 대하여 관계 지방자치단체의 지방의회와 협의해야 한다.
