지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제42조의4(설계공모에 의한 낙찰자 결정)

① 지방자치단체의 장 또는 계약담당자는 법 제13조제2항제3호에 따라 설계공모에 당선된 자를 낙찰자로 결정하려는 경우에는 설계공모를 하고, 공모에 응모한 작품을 심사하여 가장 높은 점수를 받은 자를 낙찰자로 결정하되, 가장 높은 점수를 받은 자가 2인 이상일 때에는 추첨으로 낙찰자를 결정한다.

② 지방자치단체의 장 또는 계약담당자는 설계공모에 참가하려는 자에게 공모요령 등 필요한 서류를 내주어야 한다. 이 경우 이를 지정정보처리장치에 게재함으로써 그 교부를 갈음할 수 있다.

③ 지방자치단체의 장 또는 계약담당자는 설계공모에 당선된 자 중 낙찰자로 결정되지 아니한 자에 대해서는 예산의 범위에서 공모 작품의 작성비용 일부를 보상할 수 있다.

④ 공모 작품의 심사기준ㆍ심사방법ㆍ심사절차 등에 관하여 필요한 사항은 행정안전부장관이 정한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
