지방공무원법 제9조(인사위원회의 기관)

① 인사위원회에 위원장ㆍ부위원장 각 1명을 두며, 위원장은 시ㆍ도의 국가공무원으로 임명하는 부시장ㆍ부지사ㆍ부교육감, 시ㆍ도의회의 사무처장, 시ㆍ군ㆍ구의 부시장ㆍ부군수ㆍ부구청장, 시ㆍ군ㆍ구의회의 사무국장 또는 사무과장이 되고, 부위원장은 해당 인사위원회에서 호선(互選)한다. 다만, 임용권을 위임받은 기관에 두는 인사위원회의 위원장과 부위원장은 해당 인사위원회에서 호선한다. <개정 2021.10.8>

② 제7조제1항에 따라 시ㆍ도에 복수의 인사위원회를 두는 경우 제1인사위원회의 위원장은 제1항 본문에 따르고, 제2인사위원회의 위원장은 부시장ㆍ부지사(「지방자치법」 제123조제6항 후단에 따라 특정지역의 사무를 담당하는 부시장ㆍ부지사를 말한다) 또는 인사를 담당하는 국장이 된다. <개정 2021.10.8>

③ 위원장은 인사위원회를 대표하며, 인사위원회의 사무를 총괄한다.

④ 부위원장은 위원장을 보좌하며, 위원장이 부득이한 사유로 직무를 수행할 수 없을 때에는 그 직무를 대행한다.
