Political Funds Act, Article 40 (Accounting Reports)
①회계책임자는 다음 각 호에서 정하는 기한까지 관할 선거관리위원회에 정치자금의 수입과 지출에 관한 회계보고(이하 "회계보고"라 한다)를 하여야 한다. <개정 2008.2.29, 2016.1.15, 2017.6.30, 2024.2.20>
(1) The accounting officer shall make a report on the receipts and expenditures of political funds (hereinafter referred to as an "accounting report") to the competent election commission by the deadlines set out in the following subparagraphs:
1. 정당의 회계책임자
1. The accounting officer of a political party:
가. 공직선거에 참여하지 아니한 연도
(a) In a year in which the party does not take part in an election for public office
매년 1월 1일부터 12월 31일 현재로 다음 연도 2월 15일(시ㆍ도당의 경우에는 1월 31일)까지
For January 1 to December 31 of each year, by February 15 of the following year (January 31 for Si/Do party chapters);
나. 전국을 단위로 실시하는 공직선거에 참여한 연도
(b) In a year in which the party takes part in an election for public office held nationwide
매년 1월 1일(정당선거사무소의 경우에는 그 설치일)부터 선거일 후 20일(20일 후에 정당선거사무소를 폐쇄하는 경우에는 그 폐쇄일을 말한다) 현재로 당해 선거일 후 30일(대통령선거 및 비례대표국회의원선거에 있어서는 40일)까지, 선거일 후 21일부터 12월 31일 현재로 다음 연도 2월 15일(시ㆍ도당은 1월 31일)까지
For January 1 of each year (for a party election office, the date it was established) to the 20th day after election day (if the party election office is closed after that 20th day, the date of closure), by the 30th day after election day (the 40th day for presidential elections and proportional representation National Assembly elections); and for the 21st day after election day to December 31, by February 15 of the following year (January 31 for Si/Do party chapters);
다. 전국의 일부지역에서 실시하는 공직선거의 보궐선거 등에 참여한 연도
(c) In a year in which the party takes part in a by-election or the like for public office held in only part of the country
중앙당과 정책연구소는 가목에 의하고, 당해 시ㆍ도당과 정당선거사무소는 나목에 의한다.
The central party and the policy research institute shall follow item (a), and the Si/Do party chapter concerned and the party election office shall follow item (b);
2. 후원회를 둔 국회의원ㆍ지방의회의원의 회계책임자
2. The accounting officer of a member of the National Assembly or local council member who has a supporters' association:
가. 공직선거에 참여하지 아니한 연도
(a) In a year in which he or she does not take part in an election for public office
매년 1월 1일부터 12월 31일 현재로 다음 연도 1월 31일까지
For January 1 to December 31 of each year, by January 31 of the following year;
나. 공직선거에 참여한 연도
(b) In a year in which he or she takes part in an election for public office
매년 1월 1일부터 선거일 후 20일 현재로 선거일 후 30일까지, 선거일 후 21일부터 12월 31일 현재로 다음 연도 1월 31일까지
For January 1 of each year to the 20th day after election day, by the 30th day after election day; and for the 21st day after election day to December 31, by January 31 of the following year;
3. 중앙당후원회(중앙당창당준비위원회후원회를 포함한다) 및 국회의원후원회ㆍ지방의회의원후원회의 회계책임자
3. The accounting officer of a supporters' association of a central party (including the supporters' association of a central party formation preparatory committee), of a member of the National Assembly, or of a local council member:
가. 연간 모금한도액을 모금할 수 있는 연도
(a) In a year in which the association may raise up to its annual fundraising limit
매년 1월 1일부터 6월 30일 현재로 7월 31일까지, 7월 1일부터 12월 31일 현재로 다음 연도 1월 31일까지
For January 1 to June 30 of each year, by July 31; and for July 1 to December 31, by January 31 of the following year;
나. 연간 모금한도액의 2배를 모금할 수 있는 연도
(b) In a year in which the association may raise twice its annual fundraising limit
매년 1월 1일부터 선거일 후 20일 현재로 선거일 후 30일까지, 선거일 후 21일부터 12월 31일 현재로 다음 연도 1월 31일까지. 다만, 선거일이 12월 중에 있는 경우에는 가목에 의한다.
For January 1 of each year to the 20th day after election day, by the 30th day after election day; and for the 21st day after election day to December 31, by January 31 of the following year. However, if election day falls in December, item (a) shall apply;
4. 대통령선거경선후보자ㆍ당대표경선후보자등 및 그 후원회의 회계책임자정당의 경선일 후 20일 현재로 경선일 후 30일까지. 이 경우 후원회를 둔 국회의원ㆍ지방의회의원의 회계책임자는 제2호의 규정에 불구하고 매년 1월 1일부터 경선일 후 20일 현재로 경선일 후 30일까지, 경선일 후 21일부터 12월 31일 현재로 다음 연도 1월 31일까지
4. The accounting officer of a presidential primary candidate or a party leadership primary candidate, etc. and of his or her supporters' association: for the period up to the 20th day after the day of the party primary, by the 30th day after the primary. In this case, notwithstanding subparagraph 2, the accounting officer of a member of the National Assembly or local council member who has a supporters' association shall report for January 1 of each year to the 20th day after the primary, by the 30th day after the primary, and for the 21st day after the primary to December 31, by January 31 of the following year;
5. 공직선거의 후보자ㆍ예비후보자 및 그 후원회의 회계책임자선거일 후 20일(대통령선거의 정당추천후보자의 경우 그 예비후보자의 회계책임자는 후보자등록일 전일) 현재로 선거일 후 30일(대통령선거의 무소속후보자는 40일)까지. 이 경우 대통령선거의 정당추천 후보자와 비례대표국회의원선거 및 비례대표지방의회의원선거의 선거사무소ㆍ선거연락소의 회계책임자는 제1호 나목 또는 다목에 의한다.
5. The accounting officer of a candidate or preliminary candidate in an election for public office and of his or her supporters' association: for the period up to the 20th day after election day (for the accounting officer of a preliminary candidate who becomes a party-nominated candidate in a presidential election, the day before the date of candidate registration), by the 30th day after election day (the 40th day for an independent candidate in a presidential election). In this case, the accounting officers of the election campaign offices and election liaison offices of a party-nominated candidate in a presidential election, and in proportional representation National Assembly elections and proportional representation local council elections, shall follow item (b) or (c) of subparagraph 1.
②제1항의 규정에 불구하고 다음 각 호에 해당하는 사유가 있는 때에는 그 회계책임자는 그 날부터 14일 이내에 관할 선거관리위원회에 회계보고를 하여야 한다. <개정 2008.2.29, 2010.1.25, 2016.1.15, 2017.6.30, 2024.2.20>
(2) Notwithstanding paragraph (1), if any of the following events occurs, the accounting officer shall make an accounting report to the competent election commission within 14 days from the date of the event:
1. 정당이 등록취소되거나 해산한 때
1. When the registration of a political party is canceled or the party is dissolved;
2. 후원회를 둔 중앙당창당준비위원회가 소멸한 때
2. When a central party formation preparatory committee that has a supporters' association ceases to exist;
3. 후원회가 제19조(후원회의 해산 등)제1항의 규정에 의하여 해산한 때(선거 또는 경선의 종료로 후원회지정권자가 후원회를 둘 수 있는 자격을 상실하여 해산한 때는 제외한다)
3. When a supporters' association is dissolved under Article 19 (Dissolution of Supporters' Associations, Etc.) (1) (excluding a dissolution because the person entitled to designate it loses the qualification to have a supporters' association upon the end of an election or primary);
4. 후원회를 둔 국회의원ㆍ지방의회의원, 대통령선거경선후보자 또는 당대표경선후보자등이 후원회지정을 철회하거나 후원회를 둘 수 있는 자격을 상실한 때(경선의 종료로 인하여 자격을 상실한 때는 제외한다)
4. When a member of the National Assembly or local council member who has a supporters' association, a presidential primary candidate, or a party leadership primary candidate, etc. withdraws the designation of the supporters' association or loses the qualification to have one (excluding a loss of qualification upon the end of a primary);
5. 공직선거의 예비후보자 또는 그 후원회가 선거기간개시일 30일 전에 그 자격을 상실하거나 해산할 때
5. When a preliminary candidate in an election for public office, or his or her supporters' association, loses that qualification or is dissolved more than 30 days before the first day of the election period.
③제1항 및 제2항의 규정에 의하여 회계보고하는 사항은 다음 각 호와 같다. <개정 2008.2.29, 2016.1.15, 2017.6.30>
(3) The matters to be included in accounting reports under paragraphs (1) and (2) are as follows:
1. 정당 및 후원회의 회계책임자
1. The accounting officer of a political party or supporters' association:
가. 재산상황
(a) Status of property
정당에 있어서는 12월 31일 현재의 회계보고에 한한다.
For a political party, only in the accounting report as of December 31;
나. 정치자금의 수입내역
(b) Details of receipts of political funds
1회 30만원 초과 또는 연간 300만원(대통령후보자등후원회ㆍ대통령선거경선후보자후원회의 경우에는 500만원)을 초과하여 수입을 제공한 자의 경우에는 성명ㆍ생년월일ㆍ주소ㆍ직업ㆍ전화번호와 수입일자 및 그 금액을, 그 이하 금액의 수입을 제공한 자의 경우에는 일자별로 그 건수와 총금액. 다만, 당비의 경우에는 그러하지 아니하다.
For a person who provided more than 300,000 won at one time or more than 3 million won a year (5 million won for supporters' associations of presidential candidates, etc. and of presidential primary candidates), the person's name, date of birth, address, occupation and telephone number, and the date and amount of each receipt; for persons who provided smaller amounts, the number and total amount of receipts by date. However, this does not apply to party dues;
다. 제37조(회계장부의 비치 및 기재)제1항의 규정에 의하여 회계장부에 기재하는 지출의 상세내역
(c) Details of expenditures entered in the account books under Article 37 (Keeping of and Entries in Account Books) (1);
2. 후원회지정권자(정당은 제외한다)ㆍ대통령선거경선후보자, 당대표경선후보자등, 공직선거의 후보자ㆍ예비후보자의 회계책임자(대통령선거의 정당추천 후보자, 비례대표국회의원선거 및 비례대표지방의회의원선거에 있어서는 제1호에 의한다)
2. The accounting officer of a person entitled to designate a supporters' association (excluding political parties), a presidential primary candidate, a party leadership primary candidate, etc., or a candidate or preliminary candidate in an election for public office (subparagraph 1 applies for a party-nominated candidate in a presidential election, and in proportional representation National Assembly elections and proportional representation local council elections):
가. 후원금 및 소속 정당의 지원금으로 구입ㆍ취득한 재산상황
(a) Status of property purchased or acquired with sponsorship money and support funds from his or her political party;
나. 제37조제1항의 규정에 의하여 회계장부에 기재하는 수입ㆍ지출의 상세내역
(b) Details of receipts and expenditures entered in the account books under Article 37 (1).
④제1항 내지 제3항의 규정에 의하여 회계보고를 하는 때에는 다음 각 호의 서류를 첨부하여야 한다. <개정 2008.2.29, 2012.2.29, 2017.6.30>
(4) When making an accounting report under paragraphs (1) through (3), the following documents shall be attached:
1. 정치자금의 수입과 지출명세서
1. A statement of receipts and expenditures of political funds;
2. 제39조(영수증 그 밖의 증빙서류) 본문의 규정에 의한 영수증 그 밖의 증빙서류 사본
2. Copies of receipts and other supporting documents under the main text of Article 39 (Receipts and Other Supporting Documents);
3. 정치자금을 수입ㆍ지출한 예금통장 사본
3. Copies of the bankbooks used to receive and spend political funds;
4. 제41조제1항 본문에 따른 자체 감사기관의 감사의견서와 대의기관(그 수임기관을 포함한다)ㆍ예산결산위원회의 심사의결서[제38조(정당의 회계처리)제3항의 규정에 의한 공개자료를 포함한다] 사본[정당(정당선거사무소를 제외한다)과 후원회의 회계책임자에 한한다]
4. Copies of the audit opinion of the internal audit body under the main text of Article 41 (1) and of the review resolution of the representative body (including its delegated body) or the budget and accounts committee [including the materials disclosed under Article 38 (Accounting of Political Parties) (3)] [only for the accounting officers of political parties (excluding party election offices) and supporters' associations];
5. 제41조제1항 단서의 규정에 의한 공인회계사의 감사의견서(중앙당과 그 후원회에 한한다). 다만, 정치자금의 수입ㆍ지출이 없는 경우에는 그러하지 아니하다.
5. The audit opinion of a certified public accountant under the proviso of Article 41 (1) (only for a central party and its supporters' association). However, this does not apply if there were no receipts or expenditures of political funds;
6. 잔여재산의 인계ㆍ인수서(인계의무자에 한한다). 이 경우 제58조(후보자의 반환기탁금 및 보전비용의 처리)제1항의 규정에 의한 반환ㆍ보전비용의 인계ㆍ인수서는 반환ㆍ보전받은 날부터 30일까지 제출한다.
6. The handover document for remaining property (only for persons obliged to hand it over). In this case, the handover document for returned or reimbursed amounts under Article 58 (Handling of Candidates' Returned Deposits and Reimbursed Expenses) (1) shall be submitted within 30 days from the date of return or reimbursement;
7. 제36조(회계책임자에 의한 수입ㆍ지출)제6항의 규정에 의한 예비후보자의 선거비용 지출내역서 사본(대통령선거의 정당추천후보자의 선거사무소의 회계책임자와 그 예비후보자의 회계책임자에 한한다)
7. A copy of the statement of the preliminary candidate's election expenses under Article 36 (Receipts and Expenditures by Accounting Officers) (6) (only for the accounting officer of the election campaign office of a party-nominated candidate in a presidential election and the accounting officer of that preliminary candidate).
⑤선거사무소ㆍ선거연락소의 회계책임자가 회계보고를 하는 때에는 정당의 대표자 또는 공직선거후보자와 선거사무장의 연대 서명ㆍ날인을 받아야 한다. 다만, 선거연락소의 경우에는 선거연락소장의 서명ㆍ날인을 받아야 한다.
(5) When the accounting officer of an election campaign office or election liaison office makes an accounting report, he or she shall obtain the joint signatures and seals of the representative of the political party or the candidate for public office and the election campaign manager. However, for an election liaison office, the signature and seal of the head of the election liaison office shall be obtained.
⑥회계보고 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다.
(6) Accounting reports and other necessary matters shall be prescribed by National Election Commission Regulations.
