전파법 제71조의2(조사 및 조치)

① 과학기술정보통신부장관은 다음 각 호의 어느 하나에 해당하는 경우 소속 공무원으로 하여금 이를 조사 또는 시험하게 할 수 있다. <개정 2013.3.23, 2015.1.20, 2017.7.26>

② 과학기술정보통신부장관은 제1항에 따른 조사 또는 시험을 위하여 필요한 경우 관련 자료 또는 해당 기자재의 제출을 요구할 수 있으며, 필요한 경우 소속 공무원으로 하여금 해당 무선설비 또는 기자재의 설치 장소, 해당 기관의 사무실, 사업장 등 그 밖에 필요한 장소에 출입하여 설비를 조사 또는 시험하게 할 수 있다. <개정 2013.3.23, 2017.7.26>

③ 과학기술정보통신부장관은 제2항에 따라 무선설비 또는 기자재의 설치 장소, 해당 기관의 사무실, 사업장 등 그 밖에 필요한 장소에 출입하는 경우에는 조사 7일 전까지 조사 목적, 방법, 기간 등이 포함된 조사계획을 해당 무선국 시설자 또는 출입 기관의 장에게 알려야 한다. 다만, 긴급하거나 사전에 알렸을 때 증거 인멸 등 조사의 목적을 달성할 수 없다고 인정하는 때에는 그러하지 아니하다. <개정 2013.3.23, 2017.7.26>

④ 제1항에 따른 조사 또는 시험을 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다.

(4) A어 public퍼블릭 official어^f피실 conducting컨덕팅 an앤 investigation인^v베스터게이션 or오 test테스트 under언더 paragraph패^r러그^r래^f프 (1) shall섈 carry캐^r리 a어 certificate서티^f피컷 indicating인더케이팅 his히즈 or오 her허 authority어^θ쏘^r러티 and앤드 show쇼우 it잇 to투 the^ð더 persons퍼슨즈 concerned.컨선드

⑤ 과학기술정보통신부장관은 제1항에 따른 조사 또는 시험 결과 위반 사실이 확인되었을 때에는 그 시설자, 제조ㆍ수입ㆍ판매ㆍ대여하는 자, 판매ㆍ대여할 목적으로 진열ㆍ보관ㆍ운송하거나 무선국ㆍ방송통신망에 설치하는 자에게 개선ㆍ시정ㆍ수거ㆍ철거ㆍ파기 또는 생산중지ㆍ수입중지ㆍ판매중지ㆍ사용중지 등 필요한 조치를 명하거나 관계 중앙행정기관의 장에게 필요한 조치를 명하도록 요청할 수 있다. <개정 2013.3.23, 2017.7.26>

⑥ 제1항부터 제5항까지의 규정에 따른 조사ㆍ시험 및 조치의 절차와 방법 등에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2015.12.22>
