전세사기피해자 지원 및 주거안정에 관한 특별법 제22조(「지방세징수법」에 따른 공매절차에서의 우선매수권)

① 전세사기피해주택이 「지방세징수법」에 따라 공매되는 경우 전세사기피해자는 매각결정기일 전까지 같은 법 제76조에 따른 공매보증금을 제공하고 다음 각 호의 구분에 따른 가격으로 그 주택을 우선매수하겠다는 신청을 할 수 있다.

② 지방자치단체의 장은 제1항에 따른 우선매수 신청이 있는 경우 「지방세징수법」 제92조에도 불구하고 전세사기피해자에게 매각결정을 하여야 한다.

③ 지방자치단체의 장은 여러 사람의 전세사기피해자가 우선매수 신청을 하고 제2항의 절차를 마쳤을 때에는 전세사기피해자 간의 특별한 협의가 없으면 변제받을 수 있는 임차보증금의 비율에 따라 전세사기피해주택을 매수하게 한다. <신설 2024.9.10>

④ 제1항에 따라 전세사기피해자가 우선매수 신청을 한 경우 「지방세징수법」 제88조에 따른 최고액 입찰자를 같은 법 제90조에 따른 차순위 매수신고자로 본다. <개정 2024.9.10>
