저작권법 제101조의5(정당한 이용자에 의한 보존을 위한 복제 등)

① 프로그램의 복제물을 정당한 권한에 의하여 소지ㆍ이용하는 자는 그 복제물의 멸실ㆍ훼손 또는 변질 등에 대비하기 위하여 필요한 범위에서 해당 복제물을 복제할 수 있다.

② 프로그램의 복제물을 소지ㆍ이용하는 자는 해당 프로그램의 복제물을 소지ㆍ이용할 권리를 상실한 때에는 그 프로그램의 저작재산권자의 특별한 의사표시가 없으면 제1항에 따라 복제한 것을 폐기하여야 한다. 다만, 프로그램의 복제물을 소지ㆍ이용할 권리가 해당 복제물이 멸실됨으로 인하여 상실된 경우에는 그러하지 아니하다. <개정 2023.8.8>
