재난 및 안전관리 기본법 제77조의2(적극행정에 대한 면책)

① 제77조제2항 및 제3항에 따른 재난관리책임기관의 공무원, 직원 및 긴급구조요원이 재난안전 사고를 예방하고 피해를 최소화하기 위하여 업무를 적극적으로 추진한 결과에 대하여 그의 행위에 고의 또는 중대한 과실이 없는 경우에는 같은 조 제2항 및 제3항에 따른 명단 통보 및 징계 등 요구를 하지 아니하거나 같은 조 제4항에 따른 징계 등의 책임을 묻지 아니한다.

② 다음 각 호의 사람이 제61조 또는 제66조제3항에 따른 지원 업무를 적극적으로 처리한 결과에 대하여 그의 행위에 고의나 중대한 과실이 없는 경우에는 관계 법령에 따른 징계 또는 제재 등 책임을 묻지 아니한다. <신설 2020.8.18>

③ 제1항에 따른 면책의 구체적인 기준, 운영절차 및 그 밖에 필요한 사항은 대통령령으로 정한다. 다만, 제2항제1호 및 제2호의 사람에 관한 사항은 감사원과 금융위원회의 규칙을 각각 따른다. <개정 2020.8.18>
