자동차관리법 제58조의3(자동차관리사업자의 손해배상책임)

① 자동차매매업자가 자동차를 매도하거나 매매의 알선을 하는 때에 제58조제1항 각 호의 고지를 하지 아니하거나 거짓으로 고지함으로써 자동차 매수인에게 재산상의 손해가 발생한 경우에는 그 손해를 배상하여야 한다. 이 경우 자동차성능ㆍ상태점검자가 자동차매매업자에게 거짓 또는 오류가 있는 성능ㆍ상태점검 내용을 제공함으로써 매수인에게 재산상의 손해가 발생한 경우에는 자동차매매업자는 자동차성능ㆍ상태점검자에게 구상할 수 있다. <개정 2015.1.6, 2017.10.24, 2017.12.26, 2020.10.20, 2022.11.15>

② 자동차매매업자는 업무를 개시하기 전에 제1항에 따른 손해배상책임을 보장하기 위하여 대통령령으로 정하는 바에 따라 보증보험 또는 제68조의17에 따른 공제에 가입하거나 공탁하여야 한다. <개정 2023.3.28>

③ 제2항에 따라 공탁한 공탁금은 자동차매매업자가 폐업 또는 사망한 날부터 1년 이내에는 회수할 수 없다.

④ 자동차매매업자는 매도 또는 매매의 알선이 완성된 경우에는 거래 당사자에게 손해배상책임의 보장에 관한 다음 각 호의 사항을 설명하고 관계 증서(제58조의4제2항에 따른 자동차성능ㆍ상태점검자의 보증 책임에 관한 관계 증서를 포함한다. 이하 이 조 및 제84조제4항제23호에서 같다)의 사본을 발급하거나 관계 증서에 관한 전자문서를 제공하여야 한다. <개정 2017.10.24, 2020.2.4, 2020.10.20, 2023.3.28>
