영유아보육법 제14조의2(직장어린이집 설치의무 미이행 사업장 명단 공표 등)

① 교육부장관 및 대통령령으로 정하는 기관("조사기관"이라 한다. 이하 이 조에서 같다)의 장은 제14조에 따른 직장어린이집 설치 등 의무 이행에 관한 실태 조사를 매년 실시하여야 하고, 실태 조사 대상 사업장의 사업주는 특별한 사정이 없으면 이에 따라야 한다. 이 경우, 조사기관의 장은 실태 조사를 완료한 후 그 결과를 교육부장관에게 통보하여야 한다. <개정 2022.6.10, 2023.12.26>

② 교육부장관은 제1항에 따른 실태조사 결과 직장어린이집 설치 등의 의무를 이행하지 아니한 사업장 및 실태조사에 불응한 사업장("미이행 사업장"이라 한다. 이하 이 조에서 같다)의 명단을 공표할 수 있다. 다만, 대통령령으로 정하는 사유가 있는 경우에는 그러하지 아니하다. <개정 2014.5.20, 2023.12.26>

③ 교육부장관은 제2항 본문에 따른 명단 공표를 하기 전에 그 공표 여부에 관하여 제6조에 따른 중앙보육정책위원회의 심의를 거쳐야 한다. <개정 2024.1.9>

④ 교육부장관은 제3항의 심의를 거친 명단 공표 대상 사업장의 사업주에게 대통령령으로 정하는 바에 따라 명단 공표 대상자임을 통지하여 소명기회를 주어야 한다. <개정 2023.12.26, 2024.1.9>

⑤ 제2항에 따른 공표는 교육부ㆍ고용노동부의 홈페이지에 1년간 게시하고, 2개 이상 일간지에 게재하는 방법으로 한다. <개정 2014.5.20, 2023.12.26>

⑥ 제1항부터 제3항까지의 규정에 따른 직장어린이집 설치 등 의무 이행에 관한 실태 조사의 내용과 방법, 미이행 사업장 명단 공표와 관련하여 필요한 사항은 대통령령으로 정한다. <개정 2024.1.9>
