연구개발특구의 육성에 관한 특별법 시행령 제19조의8(실증특례의 변경 신청 등)
Enforcement Decree of the Special Act on the Promotion of Special Research and Development Zones, Article 19-8 (Applications for Changes to Demonstration Exemptions, etc.)
① 법 제16조의2제11항 본문에 따라 실증특례의 변경을 신청하려는 자는 과학기술정보통신부령으로 정하는 실증특례 변경 신청서에 다음 각 호의 서류를 첨부하여 과학기술정보통신부장관에게 제출해야 한다. <개정 2025.4.15>
(1) A person who intends to apply for a change of a demonstration exemption pursuant to the main text of Article 16-2 (11) of the Act shall submit to the Minister of Science and ICT an application for change of a demonstration exemption prescribed by Ordinance of the Ministry of Science and ICT, with the following documents attached:
1. 실증특례 변경 계획서
1. A plan for changing the demonstration exemption;
2. 실증특례 이용현황 및 활용실적에 관한 자료
2. Data on the status of use and performance of use of the demonstration exemption;
3. 실증특례 변경사유서 및 변경 사유를 증명하는 자료
3. A statement of grounds for the change of the demonstration exemption and data proving the grounds for change;
4. 법 제16조의3제7항에 따른 책임보험 또는 배상방안의 변경 계획서(책임보험 또는 배상방안의 내용에 변경이 있는 경우에만 제출한다)
4. A plan for changing the liability insurance or compensation plan under Article 16-3 (7) of the Act (to be submitted only where the contents of the liability insurance or compensation plan are changed);
5. 실증특례 지정서 사본
5. A copy of the certificate of designation of the demonstration exemption;
6. 그 밖에 실증특례 변경을 위하여 과학기술정보통신부장관이 필요하다고 인정하는 자료
6. Other data that the Minister of Science and ICT deems necessary for changing the demonstration exemption.
② 과학기술정보통신부장관은 제1항에 따라 제출받은 실증특례 변경 신청서의 내용에 보완이 필요하다고 판단하는 경우에는 상당한 기간을 정하여 보완을 요구할 수 있다.
(2) Where the Minister of Science and ICT determines that the contents of the application for change of a demonstration exemption submitted under paragraph (1) need supplementation, the Minister may require supplementation by setting a reasonable period.
③ 과학기술정보통신부장관은 제1항에 따라 제출받은 실증특례 변경 신청서(제2항에 따라 보완된 경우를 포함한다)가 다음 각 호의 어느 하나에 해당하는 경우에는 그 실증특례 변경 신청서를 반려할 수 있다.
(3) The Minister of Science and ICT may return an application for change of a demonstration exemption submitted under paragraph (1) (including where supplemented under paragraph (2)) in any of the following cases:
1. 거짓이나 그 밖의 부정한 방법으로 신청 내용이 작성된 것이 명백한 경우
1. Where it is clear that the contents of the application were prepared by false or other improper means;
2. 신청 내용이 법 제16조의2제1항 각 호의 어느 하나에 해당하지 않음이 명백한 경우
2. Where it is clear that the contents of the application do not fall under any subparagraph of Article 16-2 (1) of the Act;
3. 제2항에 따른 보완 요구에 응하지 않은 경우
3. Where the request for supplementation under paragraph (2) is not complied with.
④ 과학기술정보통신부장관은 법 제16조의2제11항에 따라 실증특례의 변경을 한 경우에는 과학기술정보통신부령으로 정하는 실증특례 지정서에 제19조의3제2항 각 호의 사항을 기재하여 실증특례 변경 신청인에게 발급하고, 그 사실을 관보 또는 인터넷 홈페이지에 공고해야 한다. <개정 2025.4.15>
(4) When the Minister of Science and ICT has changed a demonstration exemption pursuant to Article 16-2 (11) of the Act, the Minister shall issue to the applicant for the change a certificate of designation of a demonstration exemption prescribed by Ordinance of the Ministry of Science and ICT stating the matters in each subparagraph of Article 19-3 (2), and publicly announce that fact in the Official Gazette or on the website.
⑤ 법 제16조의2제11항 단서에서 "대통령령으로 정하는 경미한 사항"이란 다음 각 호의 사항을 말한다. <개정 2025.4.15>
(5) The term "minor matters prescribed by Presidential Decree" in the proviso of Article 16-2 (11) of the Act means the following:
1. 상호 또는 명칭, 대표자 및 실증책임자의 성명
1. The trade name or name, and the names of the representative and the person responsible for demonstration;
2. 주된 사무소의 소재지
2. The location of the head office;
3. 특구 내 영업소, 연구소, 교육시설 또는 생산공장 등의 소재지
3. The location of business offices, research institutes, educational facilities, or production plants, etc. within the special zone.
