수산업법 제14조(면허의 유효기간)

① 제7조에 따른 어업면허의 유효기간은 10년으로 한다. 다만, 제4조제4항 및 「어장관리법」 제8조제5항에 해당하는 경우와 수산자원보호와 어업조정을 위하여 대통령령으로 정하는 경우에는 각각 그 유효기간을 10년 이내로 할 수 있다.

② 시장ㆍ군수ㆍ구청장은 제1항 단서, 제13조제5항 각 호 및 제33조제1항 각 호의 어느 하나에 해당하는 사유가 있는 경우 외에는 어업권자의 신청에 따라 면허기간이 끝난 날부터 10년의 범위에서 유효기간의 연장을 허가하여야 한다. 이 경우 여러 차례에 걸쳐 연장허가를 한 경우에는 그 총 연장허가기간은 10년을 초과할 수 없다.

③ 시장ㆍ군수ㆍ구청장은 어업권자가 유효기간의 연장을 신청하지 아니할 때에는 그 어업권에 대하여 등록된 권리자의 신청에 따라 그 어업권의 유효기간의 연장을 허가할 수 있다.

④ 시장ㆍ군수ㆍ구청장은 제2항 전단 또는 제3항에 따른 허가의 신청을 받은 날부터 해양수산부령으로 정하는 기간 내에 허가 여부를 신청인에게 통지하여야 한다.

⑤ 시장ㆍ군수ㆍ구청장이 제4항에서 정한 기간 내에 허가 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 허가를 한 것으로 본다.

⑥ 어업권은 면허의 유효기간이나 제2항의 연장허가기간이 끝남과 동시에 소멸된다.
