수산생물질병 관리법 제37조의12(수산질병관리원의 개설)

① 누구든지 수산질병관리원을 개설하지 아니하고는 수산생물진료업을 할 수 없다.

② 다음 각 호의 어느 하나에 해당하는 자는 수산질병관리원을 개설할 수 있다. <개정 2016.12.27>

③ 수산질병관리원을 개설하려는 자는 대통령령으로 정하는 시설기준을 갖추어 해양수산부령으로 정하는 바에 따라 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. 신고사항을 변경하려는 때에도 같다. <개정 2013.3.23, 2020.2.18>

④ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제3항 전단 또는 후단에 따른 신고를 받은 날부터 5일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2020.2.18>

⑤ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 제4항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2020.2.18>
