산업안전보건법 시행령 제83조(성능시험 등)

① 법 제101조에 따른 제품 제조 과정 조사는 안전인증대상기계등 또는 자율안전확인대상기계등이 법 제83조제1항에 따른 안전인증기준 또는 법 제89조제1항에 따른 자율안전기준에 맞게 제조되었는지를 대상으로 한다.

② 고용노동부장관은 법 제101조에 따라 법 제83조제1항에 따른 유해ㆍ위험기계등(이하 "유해ㆍ위험기계등"이라 한다)의 성능시험을 하는 경우에는 제조ㆍ수입ㆍ양도ㆍ대여하거나 양도ㆍ대여의 목적으로 진열된 유해ㆍ위험기계등 중에서 그 시료(試料)를 수거하여 실시한다.

③ 제1항 및 제2항에 따른 제품 제조 과정 조사 및 성능시험의 절차 및 방법 등에 관하여 필요한 사항은 고용노동부령으로 정한다.
