산업안전보건법 시행령 제18조(안전관리자의 업무 등)
Enforcement Decree of the Occupational Safety and Health Act, Article 18 (Duties of Safety Officers)
① 안전관리자의 업무는 다음 각 호와 같다.
(1) The duties of a safety officer are as follows:
1. 법 제24조제1항에 따른 산업안전보건위원회(이하 "산업안전보건위원회"라 한다) 또는 법 제75조제1항에 따른 안전 및 보건에 관한 노사협의체(이하 "노사협의체"라 한다)에서 심의ㆍ의결한 업무와 해당 사업장의 법 제25조제1항에 따른 안전보건관리규정(이하 "안전보건관리규정"이라 한다) 및 취업규칙에서 정한 업무
1. Duties deliberated on and decided by the occupational safety and health committee under Article 24 (1) of the Act (hereinafter referred to as the "occupational safety and health committee") or the safety and health council under Article 75 (1) of the Act (hereinafter referred to as the "labor-management council"), and duties set out in the workplace's safety and health management regulations under Article 25 (1) of the Act (hereinafter referred to as the "safety and health management regulations") and its rules of employment;
2. 법 제36조에 따른 위험성평가에 관한 보좌 및 지도ㆍ조언
2. Assistance, guidance, and advice concerning risk assessments under Article 36 of the Act;
3. 법 제84조제1항에 따른 안전인증대상기계등(이하 "안전인증대상기계등"이라 한다)과 법 제89조제1항 각 호 외의 부분 본문에 따른 자율안전확인대상기계등(이하 "자율안전확인대상기계등"이라 한다) 구입 시 적격품의 선정에 관한 보좌 및 지도ㆍ조언
3. Assistance, guidance, and advice on choosing suitable products when purchasing machinery, etc. subject to safety certification under Article 84 (1) of the Act (hereinafter referred to as "machinery, etc. subject to safety certification") and machinery, etc. subject to self-regulatory safety confirmation under the main text of Article 89 (1) of the Act, other than its subparagraphs (hereinafter referred to as "machinery, etc. subject to self-regulatory safety confirmation");
4. 해당 사업장 안전교육계획의 수립 및 안전교육 실시에 관한 보좌 및 지도ㆍ조언
4. Assistance, guidance, and advice on making the workplace's safety education plan and conducting safety education;
5. 사업장 순회점검, 지도 및 조치 건의
5. Patrol inspections of the workplace, guidance, and recommendations for action;
6. 산업재해 발생의 원인 조사ㆍ분석 및 재발 방지를 위한 기술적 보좌 및 지도ㆍ조언
6. Technical assistance, guidance, and advice on investigating and analyzing the causes of industrial accidents and on preventing their recurrence;
7. 산업재해에 관한 통계의 유지ㆍ관리ㆍ분석을 위한 보좌 및 지도ㆍ조언
7. Assistance, guidance, and advice on maintaining, managing, and analyzing statistics on industrial accidents;
8. 법 또는 법에 따른 명령으로 정한 안전에 관한 사항의 이행에 관한 보좌 및 지도ㆍ조언
8. Assistance, guidance, and advice on carrying out safety matters prescribed by the Act or orders issued under the Act;
9. 업무 수행 내용의 기록ㆍ유지
9. Recording and keeping records of the duties performed;
10. 그 밖에 안전에 관한 사항으로서 고용노동부장관이 정하는 사항
10. Other safety matters determined by the Minister of Employment and Labor.
② 사업주가 안전관리자를 배치할 때에는 연장근로ㆍ야간근로 또는 휴일근로 등 해당 사업장의 작업 형태를 고려해야 한다.
(2) When a business owner assigns a safety officer, he or she shall take into account the work patterns of the workplace, such as overtime work, night work, or holiday work.
③ 사업주는 안전관리 업무의 원활한 수행을 위하여 외부전문가의 평가ㆍ지도를 받을 수 있다.
(3) A business owner may receive evaluation and guidance from outside experts for the smooth performance of safety management duties.
④ 안전관리자는 제1항 각 호에 따른 업무를 수행할 때에는 보건관리자와 협력해야 한다.
(4) A safety officer shall cooperate with the health officer in performing the duties under the subparagraphs of paragraph (1).
⑤ 안전관리자에 대한 지원에 관하여는 제14조제2항을 준용한다. 이 경우 "안전보건관리책임자"는 "안전관리자"로, "법 제15조제1항"은 "제1항"으로 본다.
(5) Article 14 (2) shall apply mutatis mutandis to support for safety officers. In such cases, "chief safety and health manager" shall be read as "safety officer", and "Article 15 (1) of the Act" as "paragraph (1)".
