비상대비에 관한 법률 시행령 제40조(훈련으로 인한 재산상 손실에 대한 보상)

① 법 제23조에 따라 자원관리주관기관의 장(훈련실시기관이 군부대인 경우에는 국방부장관을 말한다. 이하 이 조에서 같다)은 훈련에 제출된 물자가 훈련으로 인하여 멸실되거나 훼손되어 원상태로의 회복이 어렵거나 그 밖의 사유로 재산상의 손실을 입은 자에게 그 손실을 보상해야 한다. <개정 2022.7.4>

② 제1항에 따라 보상을 받으려는 자는 훈련이 끝난 후 30일 이내에 행정안전부령으로 정하는 바에 따라 보상금 지급신청서를 시ㆍ도지사등 또는 군부대의 장을 거쳐 자원관리주관기관의 장에게 제출해야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2022.7.4>

③ 자원관리주관기관의 장은 제2항에 따른 보상금 지급신청서를 받은 경우에는 30일 이내에 보상금액을 결정하고 보상금 지급통지서를 신청인에게 송부해야 한다. <개정 2022.7.4>

④ 제3항에 따른 보상금액에 관하여 이의가 있는 자는 보상금 지급통지서를 받은 날부터 30일 이내에 행정안전부령으로 정하는 바에 따라 자원관리주관기관의 장에게 재심을 청구할 수 있다. 이 경우 자원관리주관기관의 장은 30일 이내에 재심결정을 하고 그 결과를 신청인에게 통지해야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2022.7.4>
