병역법 시행령 제43조(추천에 의한 전환복무)

① 경찰청장, 소방청장 또는 해양경찰청장은 법 제25조제1항에 따라 다음 해의 의무소방원이나 의무경찰대원을 추천하려는 경우에는 2월 말일까지 국방부장관에게 그 추천인원의 배정을 요청하여야 한다. <개정 2014.11.19, 2015.11.20, 2017.7.26, 2017.9.22>

② 경찰청장, 소방청장 또는 해양경찰청장은 법 제25조제1항에 따라 의무소방원이나 의무경찰대원으로 추천하는 사람의 명단을 입영일 50일 전(경찰대학 졸업예정자로서 졸업 후 의무경찰대에 복무할 사람의 경우에는 졸업하는 해의 1월 15일)까지 병무청장에게 송부하여야 한다. <개정 2014.11.19, 2015.11.20, 2016.11.29, 2017.7.26, 2017.9.22>

③ 병무청장은 제2항에 따라 경찰청장, 소방청장 또는 해양경찰청장이 추천한 사람의 명단을 받은 경우에는 입영일 45일 전까지 지방병무청장에게 이를 송부하고, 지방병무청장은 입영일 30일 전까지 본인에게 현역병입영 통지서를 송달한 후 입영부대의 장에게 입영 대상자 명부 및 병적기록표를 송부하여야 한다. <개정 2014.11.19, 2016.11.29, 2017.7.26>

④ 제3항에 따라 입영 대상자 명부를 받은 입영부대의 장은 입영 대상자가 입영한 경우에는 제18조의8제2항에 따른 입영신체검사(입영판정검사를 받지 않은 사람만 해당한다)를 한 후 지방병무청장에게 입영한 사람의 명부(인사명령서로 갈음할 수 있다)와 입영하지 않은 사람(귀가자를 포함한다)의 명부 및 병적기록표를 송부해야 한다. <개정 2021.6.22>

⑤ 국방부장관은 제4항에 따른 입영자에 대해서는 정해진 군사교육을 마치게 한 후에 전환복무를 시키고, 경찰청장, 소방청장 또는 해양경찰청장에게 전환복무의 예정기간을 명시한 전환복무자 명부와 병적기록표를 송부하여야 한다. <개정 2014.11.19, 2017.7.26>

⑥ 지방병무청장은 제3항에 따라 현역병입영 통지서를 받은 사람이 입영판정검사에서 신체등급이 7급으로 판정되거나 제18조의8제3항에 따라 귀가된 경우에는 추천 전의 신분으로 관리해야 한다. 이 경우 귀가자의 재입영시 복무기간에 관하여는 제27조제1항 및 제2항을 준용한다. <개정 2016.11.29, 2021.6.22>
