물환경보전법 시행령 제14조(오염총량초과과징금의 납부기한 연기 및 분할 납부)

① 기후에너지환경부장관 또는 오염총량관리시행 지방자치단체장이 「행정기본법」 제29조 단서에 따라 오염총량초과과징금의 납부기한을 연기하거나 분할 납부하게 하는 경우 납부기한의 연기는 그 납부기한의 다음 날부터 1년을 초과할 수 없고, 분할 납부는 12개월의 범위에서 분할 납부의 횟수를 6회 이내로 한다. <개정 2025.10.1>

② 기후에너지환경부장관 또는 오염총량관리시행 지방자치단체장은 오염총량초과과징금의 납부기한을 연기하거나 분할 납부를 하는 자가 내야 할 부과금액이 그 납부의무자의 자본금 또는 출자총액(개인사업자의 경우에는 자산총액)을 2배 이상 초과하는 경우로서 「행정기본법」 제29조 각 호의 어느 하나에 해당하는 사유가 계속되어 제1항에 따른 기간 내에도 이를 납부할 수 없다고 인정되는 경우에는 추가로 납부기한을 연기하거나 분할 납부하게 할 수 있다. <개정 2025.10.1>

③ 제2항에 따른 납부기한의 연기는 제1항에 따라 연기된 납부기한의 다음 날부터 3년을 초과할 수 없고, 분할 납부는 36개월의 범위에서 분할 납부의 횟수를 12회 이내로 한다.
