디자인보호법 제71조(디자인일부심사등록 이의신청 심사에서의 직권심사)

① 디자인일부심사등록 이의신청에 관한 심사를 할 때에는 디자인권자나 이의신청인이 주장하지 아니한 이유에 대하여도 심사할 수 있다. 이 경우 디자인권자나 이의신청인에게 기간을 정하여 그 이유에 관하여 의견을 진술할 수 있는 기회를 주어야 한다.

② 디자인일부심사등록 이의신청에 관한 심사를 할 때에는 이의신청인이 신청하지 아니한 등록디자인에 관하여는 심사할 수 없다.
