대기환경보전법 시행령 제17조(측정기기의 부착대상 사업장 및 종류 등)

① 배출시설을 운영하는 사업자는 법 제32조제1항 및 제2항에 따라 오염물질배출량과 배출허용기준의 준수 여부 및 방지시설의 적정 가동 여부를 확인할 수 있는 다음 각 호의 측정기기를 제4항부터 제6항까지에서 정하는 바에 따라 부착해야 한다. <개정 2022.5.3>

② 기후에너지환경부장관 또는 시ㆍ도지사는 법 제32조제1항 단서에 따라 사업자가 「중소기업기본법」 제2조에 따른 중소기업인 경우에는 사업자의 동의(기후에너지환경부령으로 정하는 바에 따라 사업자의 신청을 받은 경우를 포함한다)를 받아 측정기기를 부착ㆍ운영하는 등의 조치를 할 수 있다. <신설 2013.1.31, 2025.10.1>

③ 시ㆍ도지사 또는 사업자는 법 제32조제1항에 따라 측정기기를 부착하는 경우에 부착방법 등에 대하여 한국환경공단에 지원을 요청할 수 있다. <신설 2013.1.31>

④ 제1항제1호에 따른 적산전력계의 부착대상 시설 및 부착방법은 별표 2와 같다. <개정 2013.1.31>

⑤ 제1항제2호에 따라 굴뚝 자동측정기기를 부착하여야 하는 사업장은 별표 1의3에 따른 1종부터 3종까지의 사업장으로 하며, 굴뚝 자동측정기기의 부착대상 배출시설, 측정 항목, 부착 면제, 부착 시기 및 부착 유예(猶豫)는 별표 3과 같다. <개정 2013.1.31, 2016.3.29>

⑥ 제1항제3호에 따른 사물인터넷 측정기기의 부착대상 시설은 별표 1의3에 따른 4종 및 5종 사업장의 배출시설 및 방지시설 중 기후에너지환경부령으로 정하는 시설로 하며, 사물인터넷 측정기기의 부착 면제, 부착 시기 및 부착 유예는 별표 3의2에서 정하는 바에 따른다. <신설 2022.5.3, 2025.10.1>

⑦ 기후에너지환경부장관 또는 시ㆍ도지사는 굴뚝 자동측정기기로 측정되어 법 제32조제7항에 따라 전산망으로 전송된 자료(이하 "자동측정자료"라 한다)를 배출허용기준의 준수 여부 확인이나 법 제35조에 따른 배출부과금의 산정에 필요한 자료로 활용할 수 있다. 다만, 굴뚝 자동측정기기나 전산망의 이상 등으로 비정상적인 자료가 전송된 경우에는 그러하지 아니하다. <개정 2013.1.31, 2022.5.3, 2025.10.1>
