군 책임운영기관의 지정ㆍ운영에 관한 법률 제10조(기본운영규정)

① 기관장은 법령으로 정하는 범위에서 다음 각 호의 사항이 포함된 군 책임운영기관의 조직과 운영에 관한 기본운영규정(이하 "기본운영규정"이라 한다)을 작성하여야 한다.

② 기관장은 기본운영규정을 작성하거나 변경할 때에는 미리 상급 부대 또는 기관의 장을 거쳐 국방부장관의 승인을 받아야 한다. 다만, 소속 책임운영기관의 경우에는 정원 및 조직을 변경하는 사항 은 국방부장관의 승인을 받아야 하고, 그 외에는 참모총장의 승인을 받아야 한다.

③ 제2항에도 불구하고 기관장은 기본운영규정 중 총 정원의 범위에서 하부조직의 설치 및 조정 등 대통령령으로 정하는 사항은 국방부장관 또는 참모총장의 승인을 받지 아니하고 변경할 수 있다. 이 경우 기관장은 그 내용을 국방부장관 또는 참모총장에게 통보하여야 한다.
