군용항공기 운용 등에 관한 법률 제9조의2(방공식별구역을 비행하는 항공기의 비행 및 식별 절차)

① 방공식별구역을 비행하려는 자는 비행을 시작하기 전에 비행계획을 수립하여 국방부장관에게 제출하여야 한다. 다만, 긴급출동 등 국방부장관이 정하여 고시하는 사유로 비행시작 전에 비행계획을 제출하지 못하는 경우에는 비행 중에 제출할 수 있다.

② 제1항에도 불구하고 군용항공기가 아닌 항공기에 대하여 「항공안전법」 제67조제2항제4호의 비행규칙에 따라 국토교통부장관에게 비행계획을 제출한 경우에는 제1항에 따라 비행계획을 제출한 것으로 본다. 이 경우 국토교통부장관은 제출된 비행계획을 국방부장관에게 지체 없이 통보하여야 한다. <개정 2016.3.29>

(2) Notwithstanding낫위^ð드스탠딩 paragraph패^r러그^r래^f프 (1), where웨어 a어 flight^f플라잇 plan플랜 has해즈 been빈 submitted서브미티드 to투 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 for^f포 an앤 aircraft에어크^r래^f프트 other어^ð더 than^ð댄 a어 military밀러테^r리 aircraft에어크^r래^f프트 in인 accordance어코든스 with위^ð드 the^ð더 flight^f플라잇 rules^r룰즈 under언더 Article아터클 67 (2) 4 of어^v브 the^ð디 Aviation에이^v비에이션 Safety세이^f프티 Act,액트 the^ð더 flight^f플라잇 plan플랜 shall섈 be비 deemed딤드 submitted서브미티드 under언더 paragraph패^r러그^r래^f프 (1). In인 such서치 cases,케이시즈 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 shall섈 notify노우터^f파이 the^ð더 Minister미너스터 of어^v브 National내셔늘 Defense디^f펜스 of어^v브 the^ð더 submitted서브미티드 flight^f플라잇 plan플랜 without위^ð다웃 delay.딜레이

③ 제2항 후단에 따른 비행계획의 통보 절차 및 방법에 관한 세부사항은 국방부장관과 국토교통부장관이 협의하여 정한다.

④ 방공식별구역을 비행하는 모든 항공기는 대통령령으로 정하는 비행절차에 따라 비행하여야 한다. 다만, 국방부장관의 허가를 받은 경우에는 국방부장관이 정하는 비행절차에 따라 비행할 수 있다.

⑤ 국방부장관은 방공식별구역을 비행하는 모든 항공기에 대하여 비행계획과 일치하는지를 확인하여 식별하여야 한다. 이 경우 비행계획과의 대조가 어려운 경우에는 전자적 장치에 의한 확인 등 적절한 방법을 통하여 식별할 수 있다.

⑥ 국방부장관은 제5항에도 불구하고 평시에 방공식별구역에서 항공기 운항의 편의를 도모하고 방공작전의 효율성을 높이기 위하여 항공기 식별을 제한적으로 실시하는 구역을 지정할 수 있다.

(6) Notwithstanding낫위^ð드스탠딩 paragraph패^r러그^r래^f프 (5), the^ð더 Minister미너스터 of어^v브 National내셔늘 Defense디^f펜스 may메이 designate데저그네잇 zones존즈 where웨어 aircraft에어크^r래^f프트 identification아이덴터^f퍼케이션 is이즈 conducted컨덕티드 on안 a어 limited리머티드 basis베이시스 in인 peacetime피스타임 in인 order오더 to투 facilitate^f퍼실러테잇 aircraft에어크^r래^f프트 operations아퍼^r레이션즈 in인 the^ð디 air에어 defense디^f펜스 identification아이덴터^f퍼케이션 zone존 and앤드 enhance엔핸스 the^ð디 efficiency이^f피션시 of어^v브 air에어 defense디^f펜스 operations.아퍼^r레이션즈

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 방공식별구역의 구체적인 운영에 필요한 사항은 국방부장관이 정한다.
