①제2조제3호다목에 해당하는 납북피해자 및 그 유족에 대하여는 다음 각 호의 구분에 따라 산출한 금액에 보상 결정시까지의 법정이율에 따른 이자를 가산한 보상금을 지급한다.

1. 납북과 관련하여 국가공권력의 행사로 인하여 사망한 자의 유족에 대하여는 사망한 때를 기준으로 그 당시의 월급액ㆍ월실수입액 또는 평균임금에 장래의 취업가능기간을 곱한 금액에서 법정이율에 따른 단할인법으로 중간이자를 공제한 금액

나. 상이를 입은 자가 신체에 장해가 있는 경우에는 그 장해로 인한 노동력 상실정도에 따라 상이를 입은 때를 기준으로 그 당시의 월급액ㆍ월실수입액 또는 평균임금에 노동력 상실률 및 장래의 취업가능기간을 곱한 금액에서 법정이율에 따른 단할인법으로 중간이자를 공제한 금액

②납북과 관련하여 국가 공권력에 의하여 상이를 입은 자가 그 상이 외의 원인으로 사망한 경우에는 그가 생존하는 것으로 보아 제1항제2호에 따라 보상금을 지급한다.

③제1항에 따른 월급액ㆍ월실수입액 또는 평균임금은 거주지를 관할하는 시장ㆍ군수ㆍ구청장ㆍ세무서장의 증명이나 그 밖에 공신력 있는 증명에 의하고 이를 증명할 수 없을 때에는 대통령령이 정하는 바에 따른다.

④제1항에 따른 보상금을 산정함에 있어서는 월급액ㆍ월실수입액 또는 평균임금에서 대통령령으로 정하는 생활비를 공제하여야 한다.

⑤사망 또는 상이를 입을 당시의 월급액ㆍ월실수입액 또는 평균임금과 보상결정 당시의 월급액ㆍ월실수입액 또는 평균임금 사이에 현격한 차이가 있을 때에는 대통령령이 정하는 바에 따라 보상금을 조정ㆍ지급할 수 있다.
