군사법원법 제230조(군검사의 체포ㆍ구속장소 감찰)

① 군검사는 불법체포ㆍ구속 여부를 조사하기 위하여 매월 1회 이상 관하 수사기관의 피의자 체포ㆍ구속장소를 감찰하여야 한다. 감찰하는 군검사는 체포되거나 구속된 사람을 심문(審問)하고 관련 서류를 조사하여야 한다. <개정 2016.1.6>

② 군검사는 적법한 절차에 따르지 아니하고 체포되거나 구속된 것이라고 의심할 만한 상당한 이유가 있는 경우에는 즉시 체포되거나 구속된 사람을 석방하거나 사건을 검찰기관에 송치할 것을 명령하여야 한다. <개정 2016.1.6>
