군사법원법 제164조(영장의 집행과 책임자의 참여)

① 관공서나 병영, 그 밖의 군사용 청사, 항공기 또는 함선에서 압수ㆍ수색영장을 집행할 때에는 그 장 또는 그를 대리하는 사람에게 참여할 것을 통지하여야 한다.

② 제1항에 규정된 장소가 아닌 다른 사람의 주거나 관리자가 있는 가옥, 건조물, 항공기, 선박 또는 차량에서 압수ㆍ수색영장을 집행할 때에는 주거주(住居主)ㆍ관리자 또는 이에 준하는 사람을 참여하게 하여야 한다.

③ 제2항의 사람이 참여하지 못할 때에는 이웃사람 또는 지방공공단체의 직원을 참여하게 하여야 한다.
