군검찰 사건사무규칙 제50조(구속영장의 청구)

① 군검사가 「군사법원법」 제238조제1항 본문과 「군검찰사무 운영규정」 제7조제1항에 따라 구속영장을 청구하는 경우에는 별지 제74호서식의 구속영장 청구서에 따르고, 같은 법 제232조의2제5항에 따라 구속영장을 청구하는 경우에는 별지 제75호서식의 구속영장 청구서에 따른다. <개정 2022.7.12>

② 군검사가 「군사법원법」 제238조제1항 본문과 「군검찰사무 운영규정」 제8조제1항에 따라 군사법경찰관으로부터 구속영장의 신청을 받아 구속영장을 청구하는 경우에는 별지 제76호서식의 구속영장 청구서에 따르고, 「군사법원법」 제232조의2제5항에 따라 군사법경찰관으로부터 구속영장의 신청을 받아 구속영장을 청구하는 경우에는 별지 제77호서식의 구속영장 청구서에 따른다 <개정 2022.7.12>

③ 군검사는 제1항 또는 제2항에 따라 구속영장을 청구하면서 「군사법원법」 제246조에 따라 준용되는 같은 법 제110조제2항에 규정된 필요적 고려사항이 있는 경우에는 구속영장 청구서에 이를 적는다. <개정 2022.7.12>
