국가유산영향진단법 제18조(약식영향진단의 결정)

① 시장ㆍ군수ㆍ구청장은 제17조에 따른 약식영향진단 결과 해당 건설공사의 시행이 「문화유산의 보존 및 활용에 관한 법률」 제35조제1항제2호(같은 법 제74조에 따라 준용되는 경우를 포함한다) 및 「자연유산의 보존 및 활용에 관한 법률」 제17조제1항제4호(같은 법 제42조에 따라 준용되는 경우를 포함한다)에 해당하는지 여부를 결정하고 그 결과를 해당 건설공사의 시행자에게 통보하여야 한다.

② 제1항에 따라 해당 건설공사의 시행이 「문화유산의 보존 및 활용에 관한 법률」 제35조제1항제2호(제74조에 따라 준용되는 경우를 포함한다) 및 「자연유산의 보존 및 활용에 관한 법률」 제17조제1항제4호(같은 법 제42조에 따라 준용되는 경우를 포함한다)에 따른 허가를 받아야 한다고 결정을 한 경우에는 건설공사의 시행자에게 국가유산청장 또는 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다)의 허가를 받도록 안내하여야 한다. <개정 2024.2.13>
