국가배상법 제6조(비용부담자 등의 책임)

① 제2조ㆍ제3조 및 제5조에 따라 국가나 지방자치단체가 손해를 배상할 책임이 있는 경우에 공무원의 선임ㆍ감독 또는 영조물의 설치ㆍ관리를 맡은 자와 공무원의 봉급ㆍ급여, 그 밖의 비용 또는 영조물의 설치ㆍ관리 비용을 부담하는 자가 동일하지 아니하면 그 비용을 부담하는 자도 손해를 배상하여야 한다.

② 제1항의 경우에 손해를 배상한 자는 내부관계에서 그 손해를 배상할 책임이 있는 자에게 구상할 수 있다.
