공항시설관리권등록령 제53조(공항시설관리권의 일부를 분리하여 합병하는 경우의 합병의 등록)

①갑 공항시설관리권을 분할하여 그 일부를 을 공항시설관리권에 합병한 경우로서 합병의 등록을 하는 때에는 을 공항시설관리권의 등록용지중 표시란에 합병으로 인하여 갑 공항시설관리권의 등록용지로부터 이기한 뜻을 기재하고, 종전의 표시와 표시번호를 붉은선으로 지워야 한다.

②제1항의 경우 을 공항시설관리권의 등록용지중 갑구 사항란에 갑 공항시설관리권의 등록용지로부터 공항시설관리권에 관한 등록을 이기하고, 그 등록이 합병한 부분만에 관한 것이라는 뜻과 신청서의 접수연월일 및 접수번호를 기재한 후, 등록공무원이 날인하여야 한다.

③갑 공항시설관리권의 등록용지에 저당권에 관한 등록이 있는 때에는 을 공항시설관리권의 등록용지중 을구 사항란에 그 권리에 관한 등록을 이기하고, 합병한 부분만이 갑 공항시설관리권과 같이 그 권리의 목적이 된다는 뜻과 신청서접수 연월일 및 접수번호를 기재한 후 등록공무원이 날인하여야 한다.

④제3항의 규정에 불구하고 갑 공항시설관리권의 등록용지중 을구 사항란에 있는 등록내용과 동일한 등록이 을 공항시설관리권의 을구 사항란에도 있고 양 등록의 등록원인, 그 연월일, 등록의 목적 및 접수번호가 동일한 때에는 이기에 갈음하여 을 공항시설관리권의 등록용지에 갑 공항시설관리권의 번호와 그 공항시설관리권에 대하여 동일사항의 등록이 있다는 뜻을 기재하여야 한다.

⑤제51조제2항ㆍ제4항 및 제5항과 제52조의 규정은 제1항의 경우에 이를 준용한다.
