공항시설관리권등록령 제51조(일부분할의 등록)

①갑 공항시설관리권을 분할하여 그 일부를 을 공항시설관리권으로 함으로 인하여 분할의 등록을 하는 때에는 등록용지중 등록번호란에 번호를 기재하고, 표시란에 분할로 인하여 갑 공항시설관리권 등록용지로부터 이기한 뜻을 기재하여야 한다.

②제1항의 규정에 의하여 이기하는 경우 갑 공항시설관리권의 등록용지중 표시란에 잔여부분의 표시를 하고 분할로 인하여 다른 부분을 공항시설관리권의 등록용지에 이기한 뜻을 기재한 후 종전의 표시와 그 번호를 붉은선으로 지워야 한다.

③제1항의 경우 을 공항시설관리권의 등록용지중 해당구 사항란에 갑 공항시설관리권의 등록용지로부터 공항시설관리권에 관한 등록을 이기하고, 분할등록의 신청서 접수연월일과 접수번호를 기재한 후 등록공무원이 날인하여야 한다.

④제1항의 경우 갑 공항시설관리권에 저당권이 설정되어 있는 때에는 각 공항시설관리권의 등록용지에 다음 각호의 구분에 따른 등록을 하여야 한다.

⑤분할등록의 신청서에 다음 각호의 서면을 첨부한 때에는 갑 공항시설관리권의 등록용지중 저당권에 관한 등록에 을 공항시설관리권에 대한 저당권이 소멸한 뜻을 부기하여야 한다.
