공유수면 관리 및 매립에 관한 법률 제45조(준공검사)

① 매립면허취득자는 매립공사를 완료하였을 때에는 대통령령으로 정하는 바에 따라 매립지의 위치와 지목(「공간정보의 구축 및 관리 등에 관한 법률」 제67조에 따른 지목을 말한다)을 정하여 매립면허관청에 준공검사를 신청하여야 한다. 이 경우 매립면허취득자가 제38조제2항에 따라 공구를 구분하여 매립실시계획의 승인을 받은 경우에는 공구별로 준공검사를 신청할 수 있다. <개정 2014.6.3, 2017.3.21>

② 제1항에 따라 준공검사를 신청받은 매립면허관청은 대통령령으로 정하는 바에 따라 준공검사를 한 후 그 공사가 매립실시계획의 승인된 내용대로 시행되었다고 인정하면 해양수산부령으로 정하는 준공검사확인증을 내주고 그 사실을 고시하여야 하며, 매립실시계획의 승인된 내용대로 시행되지 아니한 경우에는 지체 없이 보완공사 등 필요한 조치를 명하여야 한다. <개정 2013.3.23>

③ 제1항에 따라 준공검사를 신청한 자가 제2항에 따른 준공검사확인증을 받은 경우에는 제39조제1항 각 호 및 같은 조 제2항의 인가ㆍ허가등에 따른 해당 사업의 준공검사 또는 준공인가를 받은 것으로 본다. 이 경우 매립면허관청은 그 준공검사에 관하여 미리 관계 행정기관의 장과 협의하여야 한다. <개정 2017.3.21>

④ 제3항에 따라 준공검사ㆍ준공인가의 의제를 받으려는 자는 제1항에 따라 준공검사를 신청할 때 해당 법률에서 정하는 관련 서류를 함께 제출하여야 한다.
