공무원연금법 시행령 제71조(연금액의 이체)

① 공단은 「군인연금법」 또는 「사립학교교직원 연금법」에 따른 퇴역연금ㆍ퇴직연금 또는 조기퇴직연금의 수급자가 공무원으로 임용되어 법 제26조에 따라 해당 연금법에 따른 재직기간 또는 복무기간을 합산받은 후 퇴직하거나 사망하였을 때에는 지체 없이 국방부장관이나 「사립학교교직원 연금법」에 따른 사립학교교직원연금공단(이하 "사립학교교직원연금공단"이라 한다)에 법 제74조 전단에 따른 급여액에 상당하는 금액의 이체를 요구하여야 한다.

② 제1항에 따라 국방부장관이나 사립학교교직원연금공단이 공단에 이체하여야 할 금액은 법 제74조에 따라 공무원의 퇴직 또는 사망 당시 「군인연금법」 또는 「사립학교교직원 연금법」에 따라 받을 수 있는 급여액으로 한다. 이 경우 급여액은 공무원의 퇴직 또는 사망 당시 「공무원연금법」에 따라 받은 것과 같은 종류의 급여 지급사유가 「군인연금법」 또는 「사립학교교직원 연금법」에서 동일하게 발생한 것으로 보아 산정한 금액(조기퇴직연금의 경우에는 퇴역연금 또는 퇴직연금에서 「공무원연금법」에 따른 조기퇴직연금의 감액비율만큼 감액한 금액을 말한다)으로 한다.

③ 국방부장관이나 사립학교교직원연금공단은 제1항에 따른 금액을 다음 각 호의 구분에 따라 공단에 이체하여야 한다.

④ 공단은 국방부장관이나 사립학교교직원연금공단으로부터 법 제74조 및 이 조 제3항제1호에 따라 반기별로 이체를 받는 동안에 「군인연금법」 또는 「사립학교교직원 연금법」에 따른 퇴역연금수급권ㆍ퇴직연금수급권ㆍ조기퇴직연금수급권ㆍ유족연금수급권 또는 퇴직유족연금수급권의 소멸사유, 감액사유, 그 밖에 이체에 영향을 미치는 사유가 있는지를 연 1회 이상 조사하여 국방부장관이나 사립학교교직원연금공단에 통보하여야 한다.

⑤ 공단은 국방부장관이나 사립학교교직원연금공단이 제3항의 기간 내에 공단에 해당 급여를 이체하지 아니하였을 때에는 지연된 기간 동안 해당 연도마다 1월 1일 현재 전국은행이 적용하는 정기예금금리 중 가장 높은 금리를 적용하여 산정한 이자를 가산하여 납부하게 하되, 회계연도마다 복리로 계산한다.
