가사근로자의 고용개선 등에 관한 법률 시행령 제3조(범죄경력조회)

① 가사서비스 제공기관이 법 제13조제1항 본문에 따라 범죄경력조회를 요청하는 경우에는 고용노동부령으로 정하는 바에 따라 범죄경력조회 요청서에 다음 각 호의 서류를 첨부하여 주된 사업소의 소재지를 관할하는 시ㆍ도경찰청장 또는 경찰서장에게 제출해야 한다.

② 만 12세 이하 아동의 보호ㆍ양육 서비스를 제공하는 가사근로자가 되려는 사람이 법 제13조제1항 단서에 따라 범죄경력조회 회신서를 가사서비스 제공기관에 직접 제출하기 위하여 범죄경력조회를 요청하는 경우에는 고용노동부령으로 정하는 바에 따라 범죄경력조회 요청서에 다음 각 호의 서류를 첨부하여 시ㆍ도경찰청장 또는 경찰서장에게 제출해야 한다. 이 경우 시ㆍ도경찰청장 또는 경찰서장이 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 제1호의 서류에 대한 정보를 확인할 수 있는 경우에는 그 확인으로 서류 제출을 갈음할 수 있다.

③ 제1항 또는 제2항에 따라 범죄경력조회를 요청받은 시ㆍ도경찰청장 또는 경찰서장이 법 제13조제3항에 따른 통보를 하는 경우에는 고용노동부령으로 정하는 바에 따라 범죄경력조회 회신서를 발급해야 한다.
