Act on Compensation for Persons Related to the May 18 Democratization Movement, Article 5 (Compensation)

① 관련자 또는 그 유족에게는 다음 각 호의 구분에 따라 산출한 금액에 보상 결정 시까지의 법정이율에 따른 이자를 더한 보상금을 지급한다. <개정 2025.12.30>

1. 5ㆍ18민주화운동과 관련하여 사망하거나 행방불명으로 확인된 사람의 유족: 사망하거나 행방불명된 때를 기준으로 그 당시의 월급액, 월실수입액(月實收入額) 또는 평균임금에 장래의 취업가능기간을 곱한 금액에서 법정이율에 따른 단할인법(單割引法)으로 중간이자를 뺀 금액

가. 필요한 요양으로 인하여 월급액, 월실수입액 또는 평균임금의 수입에 손실이 있는 경우에는 그 요양기간의 손실액

나. 상이를 입은 사람이 신체에 장해가 있는 경우에는 그 장해로 인한 노동력 상실 정도에 따라 상이를 입은 때를 기준으로 그 당시의 월급액, 월실수입액 또는 평균임금에 노동력 상실률 및 장래의 취업가능기간을 곱한 금액에서 법정이율에 따른 단할인법으로 중간이자를 뺀 금액

3. 5ㆍ18민주화운동과 관련하여 성폭력 피해를 입은 사람: 피해 정도 등을 고려하여 대통령령으로 정하는 금액

② 5ㆍ18민주화운동과 관련하여 상이를 입은 사람이 그 상이 외의 원인으로 사망한 경우에는 그가 살아 있는 것으로 보아 제1항제2호에 따른 보상금을 지급한다.

③ 제1항에 따른 월급액, 월실수입액 또는 평균임금은 주소지를 관할하는 시장ㆍ군수ㆍ구청장 또는 세무서장의 증명이나 그 밖의 공신력(公信力) 있는 증명에 의하고, 이를 증명할 수 없을 때에는 대통령령으로 정하는 바에 따른다.

④ 제1항에 따른 보상금을 산정할 때에는 월급액, 월실수입액 또는 평균임금에서 대통령령으로 정하는 생활비를 빼야 한다.
