Special Act on Relief for and Support to the Victims of the April 16 Sewol Ferry Disaster, Article 6 (Persons Eligible for Compensation and Consolation Support Payments)

① 배상금은 다음 각 호의 어느 하나에 해당하는 것을 말한다.

1. 4ㆍ16세월호참사로 인하여 발생한 손해(유류오염손해 및 화물에 관한 손해를 포함한다)에 대한 「민법」, 「국가배상법」 등 관계 법령에 따른 손해배상금

② 국가는 「민법」 제469조제1항에 따라 제1항제2호의 손해배상금을 대위변제할 수 있다.

③ 국가는 피해자에게 위로지원금(4ㆍ16세월호참사와 관련하여 조성된 재원 중 관계 법률에 따라 각 피해자에게 지급되도록 결정된 금액을 포함한다)이 지급되도록 하여야 한다. 위로지원금 지급의 기준ㆍ절차 등 구체적인 사항은 희생자와의 관계, 피해의 정도, 실제 양육한 사정, 부양의무의 이행 여부 등을 고려하여 심의위원회에서 정한다.
