Enforcement Decree of the Special Act on Special Promotion of Corporals Honorably Discharged After Serving 30 Months or More, Article 5 (Restrictions on Special Promotion)
법 제8조제3항에서 "상등병 만기전역자가 복무 당시 병장으로 진급할 수 없는 사유에 해당하는 징계처분이나 형사처벌을 받은 경우 등 대통령령으로 정하는 요건"이란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
The term "requirements prescribed by Presidential Decree, such as where a corporal discharged upon completion of service received a disciplinary action or criminal punishment constituting grounds on which he or she could not be promoted to sergeant at the time of service" in Article 8 (3) of the Act means any of the following cases:
1. 상등병 만기전역자가 군 복무 중의 범죄사실로 유죄의 확정판결을 받은 경우. 다만, 약식명령 청구에 따라 유죄판결을 받은 경우는 제외한다.
1. Where a corporal discharged upon completion of service has been finally convicted of a criminal act committed during military service; provided, that cases where the conviction was rendered upon a request for a summary order shall be excluded;
2. 상등병 만기전역자가 군 복무 중의 범죄사실로 강등 이상의 징계처분을 받은 경우
2. Where a corporal discharged upon completion of service has received a disciplinary action of demotion or heavier for a criminal act committed during military service.
