환경범죄 등의 단속 및 가중처벌에 관한 법률 제8조(누범의 가중)

제3조부터 제5조까지 또는 제7조의 죄로 금고 이상의 형을 선고받고 그 집행이 끝나거나 집행을 면제받은 지 3년 내에 제3조제1항, 제4조제3항 또는 제7조의 죄를 범한 자는 무기 또는 5년 이상의 유기징역에 처한다. 이 경우 제7조의 죄를 범한 자는 폐기물을 버리거나 매립함으로 인하여 취득한 가액의 2배 이상 10배 이하에 해당하는 벌금을 병과한다.
