화장품법 제26조의2(행정제재처분 효과의 승계)

제26조에 따라 영업자의 지위를 승계한 경우에 종전의 영업자에 대한 제24조에 따른 행정제재처분의 효과는 그 처분 기간이 끝난 날부터 1년간 해당 영업자의 지위를 승계한 자에게 승계되며, 행정제재처분의 절차가 진행 중일 때에는 해당 영업자의 지위를 승계한 자에 대하여 그 절차를 계속 진행할 수 있다. 다만, 영업자의 지위를 승계한 자가 지위를 승계할 때에 그 처분 또는 위반 사실을 알지 못하였음을 증명하는 경우에는 그러하지 아니하다.
