형법 제73조(판결선고 전 구금과 가석방)

① 형기에 산입된 판결선고 전 구금일수는 가석방을 하는 경우 집행한 기간에 산입한다.

② 제72조제2항의 경우에 벌금이나 과료에 관한 노역장 유치기간에 산입된 판결선고 전 구금일수는 그에 해당하는 금액이 납입된 것으로 본다.
