Special Act on the Construction and Development of Innovation Cities, Article 55 (Administrative Dispositions against Violators of Statutes, etc.)

①국토교통부장관은 다음 각 호의 어느 하나에 해당하는 자에 대하여 이 법에 따른 지정 또는 승인 등을 취소하거나 공사의 중지, 건축물 또는 장애물 등의 개축 또는 이전 그 밖에 필요한 처분을 하거나 조치를 명할 수 있다. <개정 2008.2.29, 2013.3.23, 2020.6.9>

(1) The^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 may메이 revoke^r리^v보우크 the^ð더 designation데저그네이션 or오 approval,어프^r루^v블 etc.엣세터^r러 under언더 this^ð디스 Act,액트 order오더 suspension서스펜션 of어^v브 works,워크스 reconstruction^r리컨스트^r럭션 or오 relocation^r릴로우케이션 of어^v브 buildings빌딩즈 or오 obstacles,아브스터클즈 etc.,엣세터^r러 or오 take테이크 other어^ð더 necessary네서세^r리 dispositions디스퍼지션즈 or오 measures메저즈 against어겐스트 a어 person퍼슨 falling^f팔링 under언더 any에니 of어^v브 the^ð더 following:^f팔로잉

1. 다음 각 목의 어느 하나에 해당하는 자

가. 제10조부터 제12조까지의 규정에 따른 지정 또는 승인시 부과된 조건을 지키지 아니하거나 개발계획ㆍ실시계획대로 혁신도시개발사업을 시행하지 아니한 경우

(a)어 Where웨어 the^ð더 person퍼슨 fails^f페일즈 to투 observe어브저^v브 the^ð더 conditions컨디션즈 attached어태치트 at앳 the^ð더 time타임 of어^v브 designation데저그네이션 or오 approval어프^r루^v블 under언더 Articles아터클즈 10 through^θ쓰^r루 12, or오 fails^f페일즈 to투 carry캐^r리 out아웃 the^ð디 innovation이너^v베이션 city시티 development디^v벨럽먼트 project프^r라젝트 according어코딩 to투 the^ð더 development디^v벨럽먼트 plan플랜 or오 implementation임플러멘테이션 plan;플랜

나. 제17조제1항의 규정을 위반하여 준공검사를 받지 아니한 경우

다. 제19조의 규정을 위반하여 조성토지등을 공급한 경우

라. 제20조의 규정을 위반하여 선수금을 받은 경우

(d)디 Where웨어 the^ð더 person퍼슨 receives^r러시^v브즈 advance어드^v밴스 payments페이먼츠 in인 violation^v바이얼레이션 of어^v브 Article아터클 20;

마. 제21조의 규정을 위반하여 토지상환채권을 발행한 경우

(e)이 Where웨어 the^ð더 person퍼슨 issues이슈즈 land랜드 redemption^r리뎀프션 bonds반즈 in인 violation^v바이얼레이션 of어^v브 Article아터클 21;

바. 제22조제1항의 규정에 따라 준용되는 「국토의 계획 및 이용에 관한 법률」 제65조제5항의 규정에 따른 통지를 하지 아니한 경우

(f)에^f프 Where웨어 the^ð더 person퍼슨 fails^f페일즈 to투 give기^v브 the^ð더 notice노우티스 under언더 Article아터클 65 (5) of어^v브 the^ð더 National내셔늘 Land랜드 Planning플래닝 and앤드 Utilization유털러제이션 Act,액트 applied어플라이드 mutatis뮤타티즈 mutandis뮤탠디즈 under언더 Article아터클 22 (1);

사. 제23조제2항의 규정에 따른 국유재산 및 공유재산의 처분시 부과된 조건을 지키지 아니하는 경우

(g)지 Where웨어 the^ð더 person퍼슨 fails^f페일즈 to투 observe어브저^v브 the^ð더 conditions컨디션즈 attached어태치트 at앳 the^ð더 time타임 of어^v브 disposal디스포우즐 of어^v브 State-owned스테잇-온드 and앤드 public퍼블릭 property프^r라퍼티 under언더 Article아터클 23 (2); and앤드

아. 제54조제1항의 규정에 따른 보고를 하지 아니하거나 거짓의 보고를 하거나 검사를 거부ㆍ방해 또는 기피한 경우

2. 거짓이나 그 밖의 부정한 방법으로 이 법에 따른 지정ㆍ승인ㆍ인가 또는 허가 등을 받은 자
