해양재난구조대의 설치 및 운영에 관한 법률 제10조(소집 및 현장 출동)

① 해양경찰청장, 지방해양경찰청장 및 해양경찰서장(이하 "해양경찰청장등"이라 한다)은 해수면에서 해양경찰의 수난구호 및 조난사고 예방ㆍ대응 등의 업무를 지원하기 위하여 필요한 때에는 해양재난구조대원을 소집할 수 있다.

② 해양재난구조대원은 제1항에 따른 소집명령에 따라 조난사고 등 재난현장에 출동하여 해양경찰청장등의 지휘와 감독을 받아 해양경찰 업무를 지원한다.

③ 해양재난구조대원은 제1항 및 제2항에도 불구하고 해양경찰청장등의 소집명령이 없어도 긴급하거나 통신이 두절되는 등 특별한 경우에는 자발적으로 해수면에서의 수난구호 및 조난사고 예방ㆍ대응 등의 임무를 수행할 수 있다. 이 경우 해양재난구조대장은 수난구호 및 조난사고 예방ㆍ대응 등의 임무에 관하여 해양수산부령으로 정하는 바에 따라 해양경찰청장등에게 보고하여야 한다.
