해양생태계의 보전 및 관리에 관한 법률 시행령 제20조(해양생물다양성관리계약의 체결 등)

①해양수산부장관, 관계 중앙행정기관의 장 또는 지방자치단체의 장(이하 이 조에서 "관계기관"이라 한다)은 법 제41조에 따라 해양생물다양성관리계약을 체결하려는 경우에는 해당 계약의 주요내용ㆍ대상지역ㆍ계약기간 등 필요한 사항을 관보 또는 해당 계약체결의 당사자(해당 토지ㆍ공유수면의 소유자ㆍ점유자 또는 관리인을 말하며, 이하 이 조에서 "계약당사자"라 한다)가 거주하는 지방자치단체의 공보에 공고하고, 관할 읍ㆍ면ㆍ동의 게시판에 15일 이상 게시하여야 한다. <개정 2008.2.29, 2013.3.23>

②계약당사자로부터 청약서를 제출받은 관계기관은 계약내용, 실비보상액의 지급시기ㆍ산정방법 등 필요한 사항에 대하여 청약인과 협의하여 이를 조정할 수 있으며, 그 협의ㆍ조정된 내용에 따라 청약인과 계약하여야 한다.

③관계기관 및 계약당사자는 해양생물다양성관리계약을 유지할 수 없거나 불필요하게 되어 계약을 해지하려는 경우에는 계약해지 3개월 전에 상대방에게 그 내용을 통보하고 계약을 해지할 수 있다.

④해양수산부장관은 해양생물다양성관리계약의 체결 또는 운용에 필요한 세부사항을 정하여 관계 중앙행정기관의 장 및 지방자치단체의 장에게 통보할 수 있다. <개정 2008.2.29, 2013.3.23>
